Welcome to Kanoka Travel. These Terms are the rules for using kanokatravel.com, including our private member community, forms, emails and events (together, “Kanoka”). “Kanoka Travel”, “we” and “us” mean Kanoka Travel, 59 Cliff St, Norwich, CT 06360, USA. By creating an account or using Kanoka, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use Kanoka.
1. Adults only: 21+
- You must be 21 or older to create an account, use the community, fill in our forms or join a trip. No exceptions, and no minors on any trip or in any Kanoka space. When you sign up, you confirm that you are 21 or older, and we record that confirmation.
- You must be legally able to agree to these Terms, and you must not be barred from using services like ours.
- We may ask you to prove your age and identity at any time, for example before you join a trip or attend an event. If you can’t or won’t, we may suspend your account or decline your booking.
- Couples. A couple may share one account if both partners are 21+ and both agree to these Terms. Each partner is responsible for what happens on the account.
2. Your account
- Give us accurate information, and keep it up to date.
- Keep your password private. You are responsible for everything that happens on your account. Tell us straight away if you think someone else has used it.
- One account per person or couple. Don’t create an account for anyone else, and don’t pretend to be someone you’re not.
- Membership gives you access to the community. It is not a booking and does not guarantee a place on any trip.
3. Consent-first community rules
Kanoka works because everyone treats each other with respect. These rules apply online and on every trip, event and meetup.
- Consent is required, every time. Ask, listen and accept “no” (including silence, hesitation or a soft decline) without argument. Consent can be withdrawn at any time. Never pressure anyone.
- Discretion. What members share with you stays with you. Don’t “out” anyone. Don’t screenshot, copy or share other members’ profiles, photos, posts or personal details outside Kanoka without their clear permission.
- Photos. Only post photos you have the right to share. Never photograph or post anyone without their consent. Don’t post anything that shows or suggests a minor.
- Respect. No harassment, threats, hate, bullying, stalking or unwanted sexual messages.
- Not for sale. No offering, requesting or advertising sex for money or anything else of value. No escort or sex work advertising, and no commercial solicitation or spam.
- Legal and safe. Nothing illegal, and no non-consensual intimate images. Nothing that puts others at risk. Follow the laws and local customs of the places we travel.
- Keep Kanoka working. Don’t scrape or harvest member data. Don’t use bots, upload malware, or try to get around our security or the 21+ rule.
- Hosts and venues. On trips and at events, follow the reasonable instructions of Kanoka hosts and venue rules, including any clothing-optional rules, which apply only where they are clearly labeled.
To report a problem, email travel@kanokatravel.com. We take reports seriously and handle them discreetly.
4. What you post
- You keep ownership of what you post: profile details, photos, posts and comments (“your content”).
- You give us permission to host, store, display and share your content within Kanoka, only as needed to run the community (for example, showing your profile to signed-in members). This permission ends when you delete the content or your account, except for copies other members have already reshared within Kanoka, or copies held for a short time in backups.
- You are responsible for your content. By posting, you confirm you have the right to share it and that it follows these Terms.
- We don’t check everything members post, and we’re not responsible for it. We may remove any content that we believe breaks these Terms or the law, or that puts members at risk.
- Remember that other members can see what you share in the community. Share only what you are comfortable with.
5. Suspension and termination
- You can leave at any time. Delete your account in your account settings, or email us. See our Privacy Policy for what happens to your information.
- We may warn, restrict, suspend or close an account, or remove someone from Kanoka, if we reasonably believe they broke these Terms (especially the 21+ and consent rules), put others at risk, or where the law requires it. Where it’s appropriate and safe, we will tell you why.
- If you are removed from the community, you may also be removed from future trips or events, as set out in the trip agreement.
- The sections of these Terms that by their nature should survive (such as sections 4, 8, 9, 10 and 11) continue after your account closes.
6. Trips, events and bookings
- Destination and experience pages give general information. Sample prices, “TBA” notes, dates, venues and inclusions can change until a trip is confirmed. They are not an offer or a quote.
- Every booking is made under the separate trip agreement provided at booking. It covers prices, deposits, payments, cancellations, refunds, changes, travel documents, insurance and conduct on the trip. If the trip agreement conflicts with these Terms about a booking, the trip agreement applies.
- Early access and priority booking offers for mailing list members work as described in the offer. They give you an earlier chance to book, not a guaranteed place.
- Hotels, resorts, cruise lines, airlines and other travel suppliers are independent businesses with their own terms. Within the limits of the law and your trip agreement, we are not responsible for their acts or omissions.
- You are responsible for your own travel documents, health and safety choices. That includes your own judgment around alcohol and other people.
7. Emails and messages
- We send marketing emails only if you opt in and confirm your address. You can unsubscribe at any time using the link in any email.
- We may send you service emails about your account, your inquiries or bookings, and changes to these Terms.
- We do not send marketing text messages.
8. Our content and brand
The Kanoka Travel name, logo, website design, text, photos and other materials belong to us or our licensors. You may use the site for your own personal use. Don’t copy, sell or reuse our content or branding without our written permission.
9. Disclaimers
- We work hard to keep Kanoka accurate, safe and available. But the website and community are provided “as is” and “as available”. We don’t promise they will always be error-free or uninterrupted.
- Meeting people. We don’t run background checks on members, and we can’t guarantee how anyone will behave. Use your own judgment when you connect with other members, online or in person.
- Links to other websites (such as Instagram, Facebook, X or Google Maps) are for convenience. We aren’t responsible for their content or practices.
- To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
10. Limits on our liability
- To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the website or community.
- To the fullest extent the law allows, our total liability for any claim about the website or community is limited to the greater of US$100 or the amount you paid us for use of the website or community in the 12 months before the claim. Claims about a trip are handled under that trip’s agreement.
- Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by our negligence.
11. Your responsibility to us
If you break these Terms or the law, or your content causes a claim against us, you agree to cover our reasonable losses and costs, including reasonable legal fees, to the extent the law allows.
12. Governing law and disputes
These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict-of-law rules. Before bringing a claim, please contact us first so we can try to fix it. Any legal dispute will be handled in the state or federal courts located in New London County, Connecticut, and you and we agree to those courts’ jurisdiction. This does not take away any rights you have under the consumer protection laws where you live.
13. Changes to these Terms
We may update these Terms from time to time. We will post the new version here and change the “Last updated” date. If a change is significant, we will tell members by email or with a notice on the site at least 30 days before it takes effect, unless it is needed sooner for legal or safety reasons. If you keep using Kanoka after the change takes effect, you accept the new Terms. If you don’t agree, you can delete your account.
14. General
- These Terms, the Privacy Policy and any trip agreement are the whole agreement between you and us about Kanoka.
- If any part of these Terms can’t be enforced, the rest still applies.
- If we don’t enforce a right straight away, we haven’t given it up.
- You may not transfer your account or these Terms to anyone else. We may transfer them as part of a business sale or reorganization, and this doesn’t reduce your rights.
